Information on the Protection of Personal Data
We place great importance on ensuring the security of your personal information, whether you provide it to us through our website or by other means. The "Personal Data Protection Law No. 6698" has come into force. We would like to inform you about this legislation and some definitions mentioned in the law:
Personal Data: Any information relating to an identified or identifiable natural person.
Processing of Personal Data: Any operation performed on personal data, wholly or partially by automated or non-automated means, including obtaining, recording, storing, retaining, modifying, reorganizing, disclosing, transferring, acquiring, making available, classifying, or preventing the use of such data.
Data Processor: A natural or legal person who processes personal data on behalf of the data controller under their authority.
Data Recording System: A recording system where personal data is processed based on specific criteria.
Data Controller: The natural or legal person who determines the purposes and means of processing personal data and is responsible for establishing and managing the data recording system.
1. Purpose of the Personal Data Protection and Consent Form and Our Company’s Role as Data Controller:
Our shopping website is considered the "data controller" under Law No. 6698 on the Protection of Personal Data regarding customers' personal data. This Personal Data Protection and Consent Form aims to inform customers about the personal data processing activities carried out by our shopping website and to obtain their explicit consent for the situations specified in Article 3 below.
3. Personal Data to Be Processed with Customers’ Explicit Consent and the Purpose of Processing:
For the cases where the personal data processing conditions in Article 5/2 and 6/3 of the Law are not met, our shopping website must obtain the explicit consent of customers to process personal data.
2. Purpose of Processing Personal Data of Customers:
The personal data of customers are processed within the framework of the conditions and purposes specified in Articles 5 and 6 of the Law. The personal data of customers are processed for the following purposes:
- Carrying out necessary work by the business units to allow relevant individuals to benefit from the products and services offered by our shopping website and executing related business processes,
- Conducting necessary work by the business units to carry out the commercial activities conducted by our shopping website, and executing related business processes,
- Planning and executing the commercial and/or business strategies of our shopping website,
- Ensuring the legal, technical, and commercial-business security of the individuals in a business relationship with our shopping website and customizing and promoting our products and services according to the preferences, usage habits, and needs of relevant individuals,
- Establishing potential claims and rights,
- Providing information required by legislation to authorized institutions,
- Creating and tracking visitor records,
- Ensuring the fulfillment of obligations under the Law on the Protection of Consumers, the Law on the Regulation of Retail Trade, and other legal regulations through any communication channels, including but not limited to our internet sites, social media pages, and the call center operated by our company or on behalf of our company,
- Providing better service to customers, offering various advantages, providing information on sales, marketing, promotions, campaigns, and conditions, conducting surveys, performing customer satisfaction research, expediting the ordering process, receiving orders, and ensuring delivery,
- Planning and executing customer campaigns, conducting cross-sales, determining target audiences,
- Monitoring customer movements, enhancing the user experience, improving the functionality of our website and mobile application, conducting direct and indirect marketing, personalized marketing, and remarketing activities, personalized segmentation, targeting, analysis, and company-internal reporting, and conducting market research,
- Planning and executing customer satisfaction activities and customer relationship management processes to increase customer loyalty.
In line with the consent provided by the Customer, personal data may be processed and shared with the parties specified in this Personal Data Protection Form for the purposes stated above.
Our Shopping Website reserves the right to link the behavior of users who visit the site with a cookie in their browser, even if they are not members, for the purpose of online behavioral advertising and marketing. Based on metrics such as page views, visit duration, and goal completion, remarketing lists can be created, and targeted advertisements can be shown to the user later on the site or on other sites in the Display Ad Network, based on the user’s interests.
Google may place cookies on users’ browsers or read existing cookies or use web beacons to collect information while directing Google AFS ads to our shopping website.
4. Transfer of Customers’ Personal Data:
Personal data of customers may be shared with company officials, our affiliates, business partners, suppliers, shareholders, legally authorized public institutions, and private organizations within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of the Law for the purposes stated above.
The user’s name and contact information may be shared with payment institutions to verify identity in accordance with the framework agreement of the payment institution approved at the payment stage and the Regulation on Measures to Prevent Money Laundering and Financing of Terrorism published in the Official Gazette dated January 9, 2008, and numbered 26751.
Our shopping website may transfer personal data to third parties both within the country and abroad in line with the purposes specified above and in compliance with the conditions stipulated by Law No. 6698.
5. Method and Legal Reason for Collecting Personal Data:
Personal data are collected electronically from customers. Personal data collected for the legal reasons stated above can be processed and transferred for the purposes specified in Articles 5 and 6 of the Law and in this Personal Data Protection Form.
6. Retention Periods of Personal Data:
Our shopping website retains personal data for the period specified by the relevant laws and regulations.
If the retention period for personal data is not regulated in the applicable legislation, personal data will be processed for the period necessary for the activity for which the data is processed, based on our shopping website’s practices and commercial traditions, and then deleted, destroyed, or anonymized.
Once the purpose of processing personal data has ended and the retention periods determined by the relevant legislation and our shopping website have expired, personal data will only be retained to establish evidence in the event of legal disputes or to assert the relevant right related to the personal data or for the establishment of a defense. In determining these retention periods, the statutes of limitations for asserting the relevant right and the examples of similar requests previously directed to our shopping website are taken into account. Once the specified retention period has expired, personal data will be deleted, destroyed, or anonymized.
7. Rights of Customers as Personal Data Owners:
Under Article 11 of the Law, data owners have the right to (i) learn whether personal data concerning them is being processed, (ii) request information if their personal data has been processed, (iii) learn the purpose of processing their personal data and whether they are used appropriately, (iv) learn the third parties to whom personal data is transferred domestically or abroad, (v) request correction of personal data if it is incomplete or inaccurately processed, and to request notification of the correction to third parties to whom the data has been transferred, (vi) request the deletion or destruction of personal data if the reasons for processing no longer exist, despite being processed in accordance with the Law and other relevant laws, and to request notification of the deletion or destruction to third parties to whom the data has been transferred, (vii) object to the processing of personal data through automated systems resulting in unfavorable outcomes for the person, and (viii) request compensation for damages in case of unlawful processing of personal data.
Requests regarding the use of the above-mentioned rights can be submitted by personal data owners in accordance with the methods specified by our shopping website under Law No. 6698. Our shopping website will evaluate these requests and conclude them within 30 days.
Changes may occur in the matters stated in this form in line with legal and technological developments.
